We Collect Personal Information and Other Information that You Submit
You can visit and use the Site without sharing personal information, but you will be required to provide personal information in order to sign up for a PROSE membership, to purchase a gift card, and to use certain other features of the Site. By “personal information” we mean information that identifies you as an individual, such as your name, address, payment information, phone number, and email address. We will collect any personal information from or about you that you voluntarily provide to us.
PROSE may combine information about you that we have with information we obtain from franchisees, business partners or other companies. PROSE collects information about your transactions with us, our franchisees and some of our business partners on the Site, including information about your use of services or products we offer.
To create an online PROSE account you will need to submit your email, phone number and credit or debit card information as discussed below. You may populate your account with other types of information that you choose to submit, for example, first and last name, gender and address.
Purchases of products or services must be made by credit or debit card. All credit and debit card information is provided directly to our PCI-compliant third-party payment processor. PROSE does not directly access, handle, or store your credit or debit card information. To purchase products or services using the Site, you will need to submit your name and your credit or debit card type, number, expiration date, security code, and billing address. Payment by credit or debit card is subject to the approval of the card issuer. We will not be liable in any way if a card issuer refuses to accept a credit or debit card for any reason. We will maintain a record of the purchases that you make using the Site.
In order to schedule an appointment for services using the Site you will need to identify the type(s) of services to be scheduled and you will need to submit your first name, last name, phone number and email address. You may also provide you address and gender.
If you upload a resume or submit an inquiry regarding employment at PROSE using the Site we may use the contents of your resume and inquiry to evaluate your qualifications and to otherwise consider or respond to your inquiry. Your upload of a resume or submission of an inquiry does not in any way require PROSE to review that resume or consider you for employment.
If you fill out an inquiry form on the Site with respect to PROSE franchising opportunities, you will need to submit various information pertaining to the prospective franchisee, including your name, your business name, your business’s contact information, the number of years you’ve been in business, whether or not you have franchising experience, your areas of interest, and limited financial information pertaining to your business.
If you sign up or otherwise opt in to receive promotions from us, you will need to submit your name and email address. You may also provide your physical address and phone number. We will use this information to provide you with promotional and other electronic communications. You may opt out of receiving promotional emails from us at any time by following the unsubscribe instructions contained in the applicable email or, if applicable, by customizing your communication preferences once logged into your online PROSE account. We may use third-party email providers to deliver these communications to you.
Other Information We Collect
If you use the Site while signed into your PROSE account, we will collect information on how you use your account and the Site, for example, which PROSE boutiques you book appointments with and what services you select.
The servers used to operate and provide the Site may collect data pertaining to you and the equipment, software, and communication methods you use to access the Internet and the Site, including Internet protocol (“IP”) addresses assigned to the computers and other devices from where you access the Internet, your Internet service provider (ISP), your device ID number, your approximate geographic location, your browser type, the pages you access on the Site, the websites you access before and after visiting the Site, the length of time you spend on the Site, date and time stamps, and clickstream data. PROSE may use this information to administer the Site and its servers, to generate statistical information, to monitor and analyze Site traffic and usage patterns, to monitor and prevent fraud, to investigate complaints and violations of our policies, and to improve the Site’s content and the products, services, materials, and other content that we describe or make available through the Site. We may combine this information with personally identifiable information, other Collected Information, and information obtained from third parties for security reasons. The suppliers that we use to provide the Site may collect information about your visits to the Site and other websites.
From time to time the Site may participate in or use advertising networks and related advertising services that are managed and provided by third-party advertising servers, advertising agencies, technology vendors, and research firms. These services collect anonymous information about your visits to and interactions with the Site and other websites and will use that information to target advertisements for goods and services. These targeted advertisements may appear on the Site or on other websites. Advertising networks often gather data about consumers who view advertisements to make inferences about a consumer’s interests and preferences, which enables their computers to deliver advertisements targeted directly to the consumer’s specific interests. This practice is often referred to as “online behavioral advertising.” For example, a third-party advertising network might collect information on the type of Internet browser you use, the type of computer operating system you use, the domain name of a website you visit, whether or not you visit specific pages of the Site or other websites, the location of your Internet service provider, the date and time of a visit to a website, and other interactions between you and websites.
To change your preferences with respect to certain online ads and to obtain more information about third-party ad networks and online behavioral advertising, please visit the National Advertising Initiative Consumer opt-out page or the Digital Advertising Alliance Self-Regulatory Program. Please remember that changing your settings with individual browsers or ad networks will not necessarily carry over to other browsers or ad networks. As a result, depending on the opt-outs you request, you may still see our ads from time to time.
We will use your personally identifiable information and other Collected Information for the purpose for which it was collected, for example, to process and communicate with you in connection with your purchases, to communicate with you in connection with your appointment requests, and to provide you with information and communications that you request. If you place an order or book an appointment through the Site, we will use Collected Information to communicate with you regarding your order. If you register for an account on the Site, we will use Collected Information to communicate with you regarding your account. Your location information will be used to add location information to your account, if applicable, and to understand where our users are located. If you book services, we will send you an email confirmation of your booking. Your location information will be used to find a PROSE location near you. If you contact us for support or assistance in using the Site, we may use Collected Information to determine whether or not your system meets the minimum requirements needed to access and use the Site and otherwise to contact you regarding your request.
We may share Collected Information with our Site management and hosting suppliers, payment processors, marketing and public relations service providers, email service suppliers, and other suppliers as necessary for us to provide the Site and our products and services to you and as may otherwise be permitted by applicable law. We require our suppliers to comply with all applicable data privacy laws and regulations. Our suppliers are authorized to and may use and disclose Collected Information as necessary for them to provide the applicable services to us.
Each individual PROSE boutique location may be owned by a franchisee, which is a separate legal entity from us. As a result, Collected Information may be shared with those individual franchisee entities at which you have made an appointment or done business. In addition, information that you share with any individual location may be submitted back to us and maintained by us as part of your PROSE account.
We may aggregate personally identifiable information and other Collected Information to create anonymous aggregate data on Site users, which describes users as a group but does not reveal the identity of individual users. We may use aggregate data to understand Site users’ needs, to determine Site user demographics and usage patterns, to determine what kinds of products and services we can provide, and to improve and enrich our products, our services, and the Site.
We may use Collected Information: to analyze, develop, and improve the content, materials, products, and services that we make available through the Site and the Site’s functionality; to inform marketing and communication plans and strategies; to evaluate user needs and customize Site content, promotional emails, and your browsing experience; and for other legitimate and lawful business purposes.
We may use Collected Information and share it with third parties to the extent permitted by applicable law, including to respond to subpoenas, court orders, legal process, or law enforcement request, or to establish or exercise our legal rights or defend against legal claims. We will use Collected Information and share it with third parties if we believe it is necessary in order to investigate, prevent or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of the PROSE Terms & Conditions or other agreements, or as required by law.
You can access or edit your personal information as it exists in our records and update your marketing preferences at any time by visiting your online PROSE account, if applicable, or by contacting us at email@example.com. We reserve the right to send you certain communications relating to PROSE, such as administrative communications that are considered part of your PROSE account, without offering you the opportunity to opt out of receiving them.
You can delete your PROSE account by sending a request via e-mail to firstname.lastname@example.org.
PROSE does not guarantee that loss, misuse, or alteration of Collected Information will not occur, but the we have security measures in place to help protect against the loss, misuse, and alteration of information under our control. For example, when you access our checkout and enter your credit or debit card information on our order forms, we encrypt the transmission of that information using industry standard Secure Socket Layer (SSL) technology.
The Site is not directed at children under 13 years of age. PROSE does not knowingly collect or use information from children under the age of 13 through the Site.
Ordering online products and services from us using the Site is limited to adults (ages 18+). If you are below the age of 18, please ask your parent or legal guardian’s permission before using this Site. If you believe that your child under the age of 13 has submitted any information to PROSE in connection with our Site or mobile application, and without prior verifiable parental consent, please contact us at email@example.com so that we can take steps to delete personal information that she or he provided.
If you are visiting the Site from outside the United States, please be aware that Collected Information may be transferred to, stored in, and processed in the United States (where our and our suppliers’ servers and databases are located and operated). The data protection and related laws and regulations of the United States might not be as comprehensive as those in the country from which you are accessing the Site.
