This Privacy Policy describes the information collected through this website (the “Site”) and how that information is used and shared. PROSE Holding Company and its affiliated companies (together, “PROSE,” “we,” “us,” or “our”) take the collection of your personal information seriously. PROSE and its suppliers may collect or receive the types of information described below in connection with your access to and use of the Site (together, “Collected Information”).

By accessing or using the Site or by accepting our Terms & Conditions, you (“you”) agree that you have read and understand this Privacy Policy and that you consent to the collection, use, and sharing of information as discussed below. If you do not agree with this Privacy Policy, do not access or use the Site.

This Privacy Policy is incorporated into and made a part of our Terms & Conditions. PROSE reserves the right to modify this Privacy Policy at any time. All changes will be effective immediately upon posting to the Site and, by accessing or using the Site after changes are posted, you agree to those changes. Material changes will be conspicuously posted on the Site or otherwise communicated to you.

We Collect Personal Information and Other Information that You Submit

You can visit and use the Site without sharing personal information, but you will be required to provide personal information in order to sign up for a PROSE membership, to purchase a gift card, and to use certain other features of the Site. By “personal information” we mean information that identifies you as an individual, such as your name, address, payment information, phone number, and email address. We will collect any personal information from or about you that you voluntarily provide to us.

Specifically, PROSE collects personal information when you register for a PROSE membership, when you use PROSE Boutiques, services or products, when you book an appointment for services using the Site, when you visit PROSE web and social media pages or the pages of certain PROSE partners, affiliates and franchisees, when you submit a resume or employment inquiry, and when you respond to communications from us (e.g., surveys, promotional offers, and appointment confirmations). If you provide your mobile or other phone number to us, you consent to receiving phone calls from us as described below. We will use collected personal information as described below, including to set up your PROSE membership, to process your orders for products and services and appointment requests, to communicate with you in connection with your membership and appointments, and to provide you with information and communications that you request or that we believe are relevant or may be of interest to you, subject to applicable laws and the terms of this Privacy Policy.

PROSE may combine information about you that we have with information we obtain from franchisees, business partners or other companies. PROSE collects information about your transactions with us, our franchisees and some of our business partners on the Site, including information about your use of services or products we offer.

account information

To create an online PROSE account you will need to submit your email, phone number and credit or debit card information as discussed below. You may populate your account with other types of information that you choose to submit, for example, first and last name, gender and address.

purchase information

Purchases of products or services must be made by credit or debit card. All credit and debit card information is provided directly to our PCI-compliant third-party payment processor. PROSE does not directly access, handle, or store your credit or debit card information. To purchase products or services using the Site, you will need to submit your name and your credit or debit card type, number, expiration date, security code, and billing address. Payment by credit or debit card is subject to the approval of the card issuer. We will not be liable in any way if a card issuer refuses to accept a credit or debit card for any reason. We will maintain a record of the purchases that you make using the Site.

appointment information

In order to schedule an appointment for services using the Site you will need to identify the type(s) of services to be scheduled and you will need to submit your first name, last name, phone number and email address. You may also provide you address and gender.

resume submissions & employment inquiries

If you upload a resume or submit an inquiry regarding employment at PROSE using the Site we may use the contents of your resume and inquiry to evaluate your qualifications and to otherwise consider or respond to your inquiry. Your upload of a resume or submission of an inquiry does not in any way require PROSE to review that resume or consider you for employment.

franchise inquiries

If you fill out an inquiry form on the Site with respect to PROSE franchising opportunities, you will need to submit various information pertaining to the prospective franchisee, including your name, your business name, your business’s contact information, the number of years you’ve been in business, whether or not you have franchising experience, your areas of interest, and limited financial information pertaining to your business.

mailing list information

If you sign up or otherwise opt in to receive promotions from us, you will need to submit your name and email address. You may also provide your physical address and phone number. We will use this information to provide you with promotional and other electronic communications. You may opt out of receiving promotional emails from us at any time by following the unsubscribe instructions contained in the applicable email or, if applicable, by customizing your communication preferences once logged into your online PROSE account. We may use third-party email providers to deliver these communications to you.

Other Information We Collect

account activity

If you use the Site while signed into your PROSE account, we will collect information on how you use your account and the Site, for example, which PROSE boutiques you book appointments with and what services you select.

device and browsing information and related data

The servers used to operate and provide the Site may collect data pertaining to you and the equipment, software, and communication methods you use to access the Internet and the Site, including Internet protocol (“IP”) addresses assigned to the computers and other devices from where you access the Internet, your Internet service provider (ISP), your device ID number, your approximate geographic location, your browser type, the pages you access on the Site, the websites you access before and after visiting the Site, the length of time you spend on the Site, date and time stamps, and clickstream data. PROSE may use this information to administer the Site and its servers, to generate statistical information, to monitor and analyze Site traffic and usage patterns, to monitor and prevent fraud, to investigate complaints and violations of our policies, and to improve the Site’s content and the products, services, materials, and other content that we describe or make available through the Site. We may combine this information with personally identifiable information, other Collected Information, and information obtained from third parties for security reasons. The suppliers that we use to provide the Site may collect information about your visits to the Site and other websites.

location information

In addition to the approximate geographic location information collected as discussed above, we may, with your consent, access more specific location information in order to enhance the user experience and increase the usefulness of the Site. This includes both geographical location information that you input using the Site and geographical location information collected by device-based location services (including GPS data). You may choose to allow us to access your location by granting the Site access to your location when prompted or through your device’s location services settings. The Site uses third-party analytics tools (e.g., Google Analytics, provided by Google Inc.) to collect and process data about your use of the Site, including when you visit the Site, URLs of the websites that you visit prior to visiting the Site and when you visit those websites, and IP addresses assigned to the devices from where you access the Internet. Our analytics providers may set and read cookies to collect this data and your web browser will automatically send data collected by those cookies to our analytics providers. Our analytics providers use this data to provide us with reports that we will use to improve the Site’s structure and content. advertising networks, personalized advertising, remarketing, and retargeting

From time to time the Site may participate in or use advertising networks and related advertising services that are managed and provided by third-party advertising servers, advertising agencies, technology vendors, and research firms. These services collect anonymous information about your visits to and interactions with the Site and other websites and will use that information to target advertisements for goods and services. These targeted advertisements may appear on the Site or on other websites. We will use your personally identifiable information and other Collected Information for the purpose for which it was collected, for example, to process and communicate with you in connection with your purchases, to communicate with you in connection with your appointment requests, and to provide you with information and communications that you request. If you place an order or book an appointment through the Site, we will use Collected Information to communicate with you regarding your order. If you register for an account on the Site, we will use Collected Information to communicate with you regarding your account. Your location information will be used to add location information to your account, if applicable, and to understand where our users are located. If you book services, we will send you an email confirmation of your booking. Your location information will be used to find a PROSE location near you. sharing collected information with our suppliers

We may share Collected Information with our Site management and hosting suppliers, payment processors, marketing and public relations service providers, email service suppliers, and other suppliers as necessary for us to provide the Site and our products and services to you and as may otherwise be permitted by applicable law. Each individual PROSE boutique location may be owned by a franchisee, which is a separate legal entity from us. As a result, Collected Information may be shared with those individual franchisee entities at which you have made an appointment or done business. In addition, information that you share with any individual location may be submitted back to us and maintained by us as part of your PROSE account.

aggregate data

We may aggregate personally identifiable information and other Collected Information to create anonymous aggregate data on Site users, which describes users as a group but does not reveal the identity of individual users. We may use aggregate data to understand Site users’ needs, to determine Site user demographics and usage patterns, to determine what kinds of products and services we can provide, and to improve and enrich our products, our services, and the Site.
